Congress is quickly and quietly pushing legislation that will make personal injury lawsuits for prescription drug and medical device injuries nearly impossible to pursue. The proponents of these bills are also not giving individuals a chance to weigh in – contrary to longstanding policy and practice. These bills will rig the system against individuals like you and tip the scales in favor of powerful corporate defendants. We need to send a strong message to Congress that these anti-civil justice bills must fail. Already, in less than a week three of these bills have made it past the House and are moving to the Senate for a vote. We all must act NOW.
Senate Bill 237 and House Resolutions 725 and 985 each actively limit an individual’s ability to bring a claim against a company (such as Big Pharma) or individual that has caused harm to you or a loved one. Senate Bill 237 (formerly House Resolution 720) forces a Judge’s hand and eliminates their ability to review sanctions on a case-by-case basis. H.R. 725 limits certain actions to be tried only in Federal Court, and not one’s own State Court, which often tends to be more sympathetic toward plaintiffs. Finally, H.R. 985 drastically cuts your access to lawsuits via both class-action and MDLs (Multi-District Litigation). The vast majority of cases we bring are in federal MDLs; if this Bill passes, it would be virtually impossible to bring many types of personal injury cases. Real lives are at risk – there will be no incentive for corporations to act in the best interests of patient safety and the market will become flooded with unsafe products.
